Who is responsible for product classification, and what happens if I get it wrong?

The importer of record is legally responsible for making sure products are classified correctly using the correct HTS code.

Even if you rely on a customs broker or supplier to suggest a code, the ultimate responsibility still falls on the Importer of Record. This is almost always the person or brand purchasing and importing the goods.

What happens if you misclassify a product?

Getting your HTS code wrong can result in:

  • Fines or penalties from U.S. Customs and Border Protection (CBP)

  • Delays in customs clearance or seizure of goods

  • Back-dated duties, if CBP finds underpayment during an audit

To reduce risk:

  • Always verify classifications suggested by suppliers or freight partners

  • Consult a licensed customs broker or trade compliance attorney for complex goods
